King Hood Media and Consulting is subject to the Protection of Personal Information Act, 4 of 2013 (POPIA). “Personal Information” is defined under POPIA to include (among other things): name, contact details, identifying numbers, location data, online identifiers, correspondence, opinions, and any information that relates to an identifiable natural person or juristic person.

Depending on how you interact with us, personal information we may collect includes (but is not limited to):

  • Name and surname
  • Email address
  • Postal or physical address
  • Telephone number (fixed or mobile)
  • Account login details (for authentication and access)

  • Gender

  • Not be subject to automated decision-making that unlawfully impacts you (section 71 POPIA).
  • Lodge complaints with the Information Regulator (complaints.IR@justice.gov.za).

7. Sharing Your Personal Information

We may share your information with:

  • Our subsidiaries and sub-brands;
  • Business partners and service providers (under binding contracts as POPIA “operators”);
  • Debt collection agencies (if applicable);
  • Government and regulators where required by law;
  • Third parties in mergers, acquisitions, or restructuring transactions.

All third parties are bound by operator agreements (section 21 POPIA) to protect and only use your information for the specified purpose.

8. Security of Your Personal Information

We use appropriate physical, administrative, and technical safeguards to secure your data. Third parties acting on our behalf are contractually required to do the same.

9. Cross-Border Transfers

Where your information is transferred outside South Africa (e.g. cloud hosting or AI platforms), we ensure that such transfers comply with section 72 of POPIA — only to jurisdictions with adequate protection, or under agreements providing equivalent safeguards.

10. AI Policy

We use AI tools to assist with service delivery. Client data is:

  • Used only for the agreed project purpose;
  • Not used to “train” external AI models (strict no-train policy);
  • Shared with sub-processors only under strict agreements ensuring POPIA compliance;
  • Deleted or de-identified after project completion unless lawfully required to be retained.

11. Direct Marketing

In line with section 69 of POPIA:

  • We will only send electronic direct marketing (email/SMS) to:
    • Existing customers, with an opt-out option; or
    • New customers who have expressly opted-in.
  • You may unsubscribe at any time via the unsubscribe link, Contact Page, or by emailing admin@kinghood.co.za.
  • Opt-out requests will be honoured as soon as reasonably practicable.

12. Cookies and Similar Technologies

We use cookies and similar technologies to improve website performance, analyse traffic, and personalise content. By using our site, you consent to our use of cookies. Where required by law, you will be asked to provide explicit consent before non-essential cookies are placed.

13. Retention and Destruction of Personal Information

We will retain personal information only as long as necessary for the purposes collected, unless longer retention is required by law, contract, or litigation. Once no longer required, personal information will be securely deleted, destroyed, or de-identified in line with section 14 of POPIA.

14. Information Officer

King Hood Media and Consulting has appointed an Information Officer in terms of section 55 of POPIA. The Information Officer is responsible for compliance with POPIA and is duly registered with the Information Regulator.
