Terms and Conditions
These Terms and Conditions (“Terms”) govern all services, packages, products, and offers provided by King Hood Media and Consulting (Pty) Ltd (“King Hood Media”, “we”, “our”, or “us”) through our website https://kinghoodmedia.com, quotations, proposals, invoices, and related service channels.
By accessing our website, requesting a quotation, accepting a proposal, purchasing any product, or engaging our services, you agree to be bound by these Terms.
Consumer Protection Act Notice
Nothing in these Terms is intended to limit, exclude, or waive any rights you may have under the Consumer Protection Act, 68 of 2008 (“CPA”). In the event of any conflict between these Terms and the CPA, the CPA shall prevail.
1. Special Small Business Discount
1.1 King Hood Media may, at its sole discretion, offer discounts on selected packages to qualifying small businesses.
1.2 To qualify, the business must:
a. Be a South African registered entity; and
b. Have an annual turnover of less than R2 million.
1.3 The discount is only available upon request and subject to written confirmation from King Hood Media.
1.4 The award, amount, and continuation of any discount remain at the sole discretion of King Hood Media and may be withdrawn or amended at any time before acceptance of a quotation.
2. Payment Terms
2.1 Unless otherwise agreed in writing:
a. A 50% deposit is payable upfront before work begins; and
b. The remaining 50% balance is payable upon delivery of the first draft, or before final handover, whichever applies to the project.
2.2 Quotations are valid for seven (7) calendar days from the date of issue, unless otherwise stated in writing.
2.3 Payments must be made in full, free of set-off, deduction, or withholding, into King Hood Media’s nominated bank account.
2.4 All package prices exclude VAT, travel costs, accommodation, courier fees, printing, third-party fees, platform subscriptions, and any additional services unless expressly included in the quotation.
2.5 Deposits secure project time, planning, resources, supplier bookings, and production capacity.
2.6 Where a project or booking is cancelled, King Hood Media may retain a reasonable and proportionate portion of the deposit to cover work already performed, resources allocated, supplier costs, opportunity cost, and any loss or prejudice suffered by King Hood Media.
2.7 Any cancellation fee or retained deposit will be applied in a manner that is reasonable and proportionate to the circumstances.
2.8 All printing requests require 100% upfront payment before production begins.
2.9 No printing job will be sent to print or production until full payment has cleared in King Hood Media’s nominated bank account and the Client has provided written approval of the final proof, artwork, specifications, quantities, sizes, dimensions, and measurements.
2.10 Printing payments are non-refundable once the job has been approved by the Client and sent to production, except where required by law or where the issue is caused directly by King Hood Media or its appointed supplier.
3. Production Timelines
3.1 Standard production timelines for design, multimedia, photography, videography, social media content, website development, and service packages are generally 7–14 working days from receipt of:
a. A signed-off brief;
b. All required content, information, access details, and materials from the Client; and
c. Payment of the required deposit.
3.2 Timelines may vary depending on the size, complexity, urgency, scope, and supplier requirements of the project.
3.3 Delays caused by late, incomplete, incorrect, unclear, or missing content submissions by the Client will extend delivery timelines and may result in additional charges.
3.4 King Hood Media will not be liable for delays caused by Client inaction, late approvals, third-party platforms, suppliers, courier delays, load shedding, internet outages, or events outside our reasonable control.
4. Travel Costs
4.1 A 15 km radius from Alberton, Johannesburg is included free of charge, unless otherwise stated in the quotation.
4.2 Travel beyond 15 km will be charged at R5.50 per km, unless otherwise agreed in writing.
4.3 For projects outside Gauteng, all travel, accommodation, meals, transport, parking, and related expenses will be quoted separately and are payable by the Client.
5. Bookings, Cancellations and Client Responsibilities
5.1 Photography, videography, podcast, and production bookings are only confirmed once the required deposit has been paid and written confirmation has been received.
5.2 Photography bookings must be made at least seven (7) working days before the event date to secure availability.
5.3 Photography bookings requested within seven (7) working days of the event are subject to availability and may attract an urgent booking fee.
5.4 Cancellations for photography, video, podcast, or production bookings made less than 24 hours before the booking may result in King Hood Media retaining a reasonable portion of the deposit to cover work already performed, resources allocated, supplier costs, and loss suffered.
5.5 Where no deposit was paid, King Hood Media may charge a reasonable cancellation fee of up to 50% of the booking value, depending on the work already performed, resources allocated, and loss suffered.
5.6 Clients are responsible for arriving on time and ensuring that venues, products, people, permissions, access, and required materials are available at the agreed time.
5.7 Delays caused by the Client do not reduce the fee payable. Additional time may be billed as a new booking or charged at the applicable hourly rate.
5.8 Additional shoots, extensions, revisions, or services beyond the original scope will be billed at R1,250 per hour, exclusive of VAT, unless otherwise agreed in writing.
6. Drafts, Revisions and Approvals
6.1 Clients are entitled to two (2) free rounds of revisions per package, unless otherwise stated in the quotation.
6.2 Additional revisions, changes in direction, or changes outside the approved brief will be charged at R1,250 per hour, exclusive of VAT.
6.3 Drafts, proofs, concepts, and creative work may be sent via email, WhatsApp, shared link, or another agreed platform.
6.4 Clients are required to review drafts, proofs, concepts, artwork, captions, schedules, and deliverables carefully before approval.
6.5 If no feedback is received within 72 hours of delivery of a draft or proof, King Hood Media may follow up and pause the project timeline until written feedback or approval is received.
6.6 Social media content plans, calendars, captions, and posting schedules must be approved by the Client before implementation.
6.7 Once a Client has approved a draft, proof, design, artwork, schedule, or final deliverable, any further changes may result in additional costs and extended timelines.
7. Printing Proofs, Measurements and Sign-Off
7.1 All printing requests require 100% upfront payment before production begins.
7.2 All printing jobs require a final proof to be shared with the Client for written approval before production begins.
7.3 The Client is responsible for carefully checking and approving all artwork, spelling, grammar, colours, logos, layout, specifications, quantities, sizes, dimensions, and measurements before printing.
7.4 The Client is responsible for confirming that all measurements supplied for banners, tablecloths, signage, clothing, packaging, décor, exhibition material, or any other printed item are correct before print approval.
7.5 Printing will only proceed once:
a. Full payment has cleared in King Hood Media’s nominated bank account; and
b. The Client has provided written approval by email, WhatsApp, signed proof, or another written confirmation method accepted by King Hood Media.
7.6 Once artwork, sizes, measurements, quantities, and specifications have been approved by the Client, King Hood Media will not be liable for errors, incorrect sizing, incorrect specifications, or changes required after printing has started, except where such error is caused directly by King Hood Media or its appointed supplier.
7.7 Any reprints, amendments, or corrections required after Client approval may be quoted and charged separately.
7.8 Printing quotes are valid for 30 days, unless otherwise stated in writing.
7.9 Print delivery quantities may be subject to reasonable industry variances, where applicable.
7.10 Any printing complaints must be submitted in writing within seven (7) calendar days of delivery or collection.
8. Service-Specific Terms
8.1 Voice Overs: Standard packages include selected voice-over artists for a 2–3 minute read, licensed for online, web, and social media use only. Special voice-over requests, extended usage, broadcast usage, or additional languages may incur additional costs.
8.2 Stock Footage: Where included, stock footage is subject to third-party licensing terms. Additional or replacement stock clips will be charged separately.
8.3 Music: Where included, stock audio tracks are subject to third-party licensing terms. Additional, replacement, custom, or specially licensed tracks will be charged separately.
8.4 E-commerce and Shopify: Monthly Shopify fees, app fees, transaction fees, domains, hosting, payment gateway charges, and third-party integrations are excluded unless expressly included in the quotation.
8.5 Websites: Clients must provide all required website content, including text, images, videos, product information, policies, pricing, and login/access details. Website builds generally take 7–14 working days after receipt of the signed brief, required content, access details, and deposit.
8.6 Website Maintenance: Website maintenance plans may be quoted separately and may include updates, content changes, product management, basic SEO support, security updates, and admin support, depending on the selected package.
9. Client Content, Materials and Access
9.1 The Client is responsible for supplying accurate, lawful, complete, and usable content, including logos, brand guidelines, copy, product details, images, videos, access credentials, contact details, and legal information.
9.2 The Client warrants that it has the necessary rights, permissions, and licences to use any content, images, music, trademarks, logos, personal information, or materials supplied to King Hood Media.
9.3 King Hood Media will not be liable for delays, errors, legal claims, or additional costs arising from incorrect, incomplete, unauthorised, or unlawful materials supplied by the Client.
10. Sample Packs Licence
10.1 By purchasing King Hood Music Sample Packs, you are granted a non-exclusive, non-transferable licence to use the sounds in your musical compositions, subject to these Terms.
10.2 Sounds may be used in commercial music, broadcasts, films, games, and multimedia projects as part of a new creative work.
10.3 Sounds may not be sold, sublicensed, distributed, repackaged, uploaded, or made available in isolation or as part of competing sample packs, sound libraries, or similar products.
10.4 All rights not expressly granted remain with King Hood Media or the relevant rights holder.
11. AI and Data Use
11.1 King Hood Media may use AI-driven tools to support certain projects, including research, ideation, content development, editing, design support, automation, reporting, and workflow improvement.
11.2 By providing content, data, or project material to King Hood Media, the Client grants King Hood Media a limited licence to process such information only for the purpose of fulfilling the agreed project.
11.3 King Hood Media follows a “no-train” approach where reasonably possible and will not knowingly use confidential Client data to train external public AI models.
11.4 AI-assisted outputs are reviewed by King Hood Media before delivery; however, the Client remains responsible for final approval, factual checking, legal review, and suitability of any approved deliverables.
11.5 Unless otherwise agreed in writing, final approved deliverables created using AI-assisted workflows are provided to the Client for use within the agreed project scope once full payment has been received.
11.6 King Hood Media retains ownership of internal prompts, systems, workflows, templates, processes, and unpublished working files used to create AI-assisted outputs.
12. Data Protection and POPIA Compliance
12.1 King Hood Media complies with the Protection of Personal Information Act, 4 of 2013 (“POPIA”).
12.2 Personal information collected may include names, contact details, company information, project briefs, billing details, images, video footage, voice recordings, and other information required to deliver services.
12.3 Personal information will only be used for:
a. Service delivery;
b. Communication and invoicing;
c. Project management;
d. Legal and regulatory compliance;
e. Business record-keeping; and
f. Any other purpose agreed to by the Client.
12.4 Personal information will be kept confidential and stored using reasonable security safeguards.
12.5 King Hood Media will not share personal information with third parties except:
a. Where required by law;
b. Where necessary to complete the project through subcontractors, freelancers, suppliers, hosting providers, software providers, payment providers, or service providers;
c. Where necessary for legal, accounting, or compliance purposes; or
d. With the Client’s consent.
12.6 Where information is transferred outside South Africa through cloud-based, software, or AI service providers, King Hood Media will take reasonable steps to ensure that such transfer is handled in accordance with POPIA.
12.7 Personal information will only be retained for as long as necessary for the purpose for which it was collected, or as required by law, after which it will be securely deleted, archived, or anonymised where appropriate.
12.8 Under POPIA, data subjects may request access to, correction of, or deletion of their personal information, subject to applicable legal and contractual limitations.
12.9 King Hood Media may send marketing communications only where permitted by law or where consent has been provided. Clients and users may opt out of marketing communications at any time.
12.10 Any direct marketing communication sent by King Hood Media will include the sender’s identity and a reasonable way to opt out, where required by law.

13. Affiliate Links
13.1 Some website content may include affiliate links.
13.2 King Hood Media may earn commissions from purchases made through such links, at no additional cost to the Client or website user.
13.3 Affiliate links do not determine or unduly influence King Hood Media’s editorial content, recommendations, or professional opinions.
14. Intellectual Property
14.1 Unless otherwise agreed in writing, all concepts, drafts, working files, templates, source files, raw footage, raw images, editable design files, project systems, workflows, strategies, and internal processes remain the intellectual property of King Hood Media.
14.2 Once full payment has been received, the Client receives the right to use the final approved deliverables for the purpose and scope agreed in the quotation, invoice, proposal, or written agreement.
14.3 Editable files, raw files, source files, templates, and project files are not included unless expressly quoted and paid for.
14.4 King Hood Media may display completed work in its portfolio, website, proposals, social media, case studies, and marketing material unless the Client requests confidentiality in writing before the project begins.
14.5 The Client may not resell, redistribute, sublicense, or claim ownership of King Hood Media’s internal systems, templates, strategies, processes, workflows, or working files unless expressly agreed in writing.
15. Confidentiality
15.1 Both parties agree to keep confidential any non-public business, financial, strategic, technical, creative, or personal information shared during a project.
15.2 Confidentiality obligations do not apply to information that is publicly available, already known, independently developed, or required to be disclosed by law.
16. Disclaimers and Limitation of Liability
16.1 Website content, articles, videos, resources, templates, and thought pieces are provided for general informational purposes only and do not constitute legal, financial, tax, medical, or other regulated professional advice.
16.2 King Hood Media does not warrant that website content, services, platforms, third-party tools, AI outputs, or digital systems will be uninterrupted, error-free, or suitable for every specific purpose.
16.3 To the fullest extent permitted by South African law, King Hood Media shall not be liable for indirect, incidental, special, or consequential losses, including loss of profits, loss of data, loss of revenue, business interruption, or reputational harm arising from the use of our services, products, or content.
16.4 Nothing in these Terms excludes liability where such exclusion is not permitted by law.
16.5 The Client remains responsible for reviewing and approving all final deliverables before publication, printing, posting, distribution, or commercial use.
17. Force Majeure
17.1 King Hood Media shall not be liable for delays or failure to perform caused by events beyond its reasonable control, including power outages, internet failures, strikes, illness, accidents, weather disruptions, supplier delays, equipment failure, load shedding, government restrictions, natural disasters, platform outages, or other force majeure events.
18. Governing Law and Jurisdiction
18.1 These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
18.2 The parties consent to the jurisdiction of the courts of the Republic of South Africa, subject to any applicable consumer rights under the CPA.
19. General
19.1 These Terms, together with any accepted quotation, proposal, invoice, or written agreement, constitute the agreement between King Hood Media and the Client.
19.2 If there is a conflict between these Terms and a signed written agreement, the signed written agreement shall prevail.
19.3 No variation of these Terms shall be valid unless recorded in writing and accepted by King Hood Media.
19.4 King Hood Media reserves the right to update these Terms from time to time. Updated versions will be published on the website and will apply from the date of publication, unless otherwise stated.
19.5 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in force.
