These Terms and Conditions (“Terms”) govern all services, packages, products, and offers provided by King Hood Media and Consulting (Pty) Ltd (“King Hood Media”, “we”, “our”, or “us”) through our website https://kinghoodmedia.com. By accessing our website, purchasing any product, or engaging our services, you agree to be bound by these Terms.


Consumer Protection Act Notice: Nothing in these Terms is intended to limit or waive any rights you may have under the Consumer Protection Act, 68 of 2008 (“CPA”). In the event of any conflict between these Terms and the CPA, the provisions of the CPA shall prevail.


1. SPECIAL SMALL BUSINESS DISCOUNT
1.1 King Hood Media may, at its sole discretion, offer discounts on selected packages to qualifying small businesses.
1.2 Eligibility criteria:
The business must be a South African registered entity; and
Must have an annual turnover of less than R2 million.
1.3 The discount is only available upon request and subject to written confirmation from King Hood Media.
1.4 The award and amount of the discount remain at the sole discretion of King Hood Media and may be withdrawn at any time.
2. PAYMENT TERMS
2.1 Unless otherwise agreed in writing:
A 50% deposit is payable upfront; and
The remaining 50% balance is payable upon delivery of the first draft.
2.2 Quotes are valid for seven (7) days from date of issue.
2.3 Payments must be made in full, free of set-off or deduction, into King Hood Media’s nominated bank account.
2.4 All package prices exclude VAT and applicable travel costs.
2.5 Deposit Justification: Deposits serve as a genuine pre-estimate of the losses King Hood Media would suffer in the event of cancellation, including time, resource allocation, and opportunity cost. In line with the Conventional Penalties Act, 15 of 1962, deposits or cancellation fees charged will always be proportionate to the prejudice suffered.
3. PRODUCTION TIMELINES
3.1 Standard production timelines for design, multimedia, photography, videography, social media content, and service packages are 7–14 working days from receipt of:
A signed-off brief; and
All required content and materials from the Client.
3.2 Delays caused by late or incomplete content submissions by the Client will extend delivery timelines and may result in additional charges (see Clause 9).
4. TRAVEL COSTS
4.1 A 15 km radius from Alberton, Johannesburg is included free of charge.
4.2 Travel beyond 15 km will be charged at R5.50 per km.
4.3 For projects outside Gauteng, all travel and accommodation expenses will be quoted separately and are payable by the Client.
5. CANCELLATION & CLIENT RESPONSIBILITIES
5.1 Photo & Video bookings:
Cancellations made less than 24 hours before the booking will result in forfeiture of the deposit.
Where no deposit was paid, a 50% cancellation fee of the booking value shall apply.
5.2 Punctuality: Clients are responsible for arriving on time. Delays caused by the Client do not reduce the fee payable. Additional time will be billed as a new booking.
5.3 Additional shoots or extensions beyond the scope of the original quote will be billed at R1,250 per hour, exclusive of VAT.
6. DRAFTS, REVISIONS & APPROVALS
6.1 Clients are entitled to two (2) free drafts/revisions per package. Thereafter, further changes will be charged at R1,250 per hour.
6.2 Drafts will be sent via email. If no feedback is received within 72 hours, the draft shall be deemed approved.
6.3 Social media posting plans must be signed off monthly before implementation.
7. SERVICE-SPECIFIC TERMS
Voice Overs: Standard packages include selected artists for a 2–3 minute read, licensed for online/web/social media use only. Special requests may incur additional costs.
Stock Footage: Gold and Animated Explainer packages include 5 stock footage clips. Additional or replacement clips will be charged at R650 each.
Music: Packages include 1 stock audio track. Additional or replacement tracks will be charged at R500 each.
E-commerce (Shopify): Monthly Shopify fees are excluded and payable directly to Shopify. Domains and hosting are also excluded unless separately quoted.
Websites: Clients must provide all website content (text, images, videos). Website builds take 7–14 working days after receiving a signed brief and content. Maintenance plans are available at R5,250 per month.
8. SAMPLE PACKS LICENSE
By purchasing King Hood Music Sample Packs, you are granted a non-exclusive, non-transferable license to use the sounds in your musical compositions, subject to:
Sounds may be used in commercial music, broadcasts, films, games, and multimedia projects.
Sounds may not be sold, sublicensed, or distributed in isolation or as part of competing products.
All rights remain with King Hood Media.
9. PRINTING SERVICES
Printing services are subject to the standard recognised customs of the South African printing industry, including:
Quotes valid for 30 days;
Proofs approved by the Client are binding;
Delivery variances of ±10% are acceptable;
Complaints must be submitted in writing within 30 days of delivery.
10. AI & DATA USE
10.1 King Hood Media uses AI-driven tools in certain projects. By providing content and data, you grant us a limited license to process such information for the purpose of fulfilling your project.
10.2 King Hood Media maintains a strict “no-train” policy, ensuring Client data is not used to train external AI models.
10.3 Deliverables created using AI remain the intellectual property of King Hood Media. Clients receive a non-exclusive license to use such deliverables for commercial purposes as per agreed scope.
10A. DATA PROTECTION & POPIA COMPLIANCE
10A.1 King Hood Media complies with the Protection of Personal Information Act, 4 of 2013 (POPIA).
10A.2 Personal information collected may include names, contact details, company information, project briefs, and billing details.
10A.3 Such information will only be used for:
Service delivery;
Communication and invoicing;
Legal and regulatory compliance; and
Business record-keeping.
10A.4 Information will be kept confidential and stored securely.
10A.5 We will not share your personal information with third parties except:
Where required by law;
Where necessary to subcontractors/service providers to complete your project; or
With your consent.
10A.6 If data is transferred outside South Africa (e.g., via third-party cloud or AI providers), it will only be to jurisdictions with adequate data protection laws or under agreements ensuring POPIA compliance.
10A.7 Personal information is retained only for as long as necessary for the purpose collected or as required by law. Thereafter, it is securely deleted or anonymised.
10A.8 Under POPIA, you have the right to:
Access and request correction/deletion of your information;
Withdraw consent to processing (subject to contract); and
Lodge complaints with the Information Regulator (complaints.IR@justice.gov.za).

11. AFFILIATE LINKS
Some website content may include affiliate links. King Hood Media may earn commissions on purchases made via such links, at no additional cost to you. Affiliate links do not influence editorial content or recommendations.
12. DISCLAIMERS & LIMITATION OF LIABILITY
12.1 Website content (articles, videos, thought pieces) is provided for informational purposes only and does not constitute professional advice.
12.2 King Hood Media does not warrant that services or content will be error-free or fit for a particular purpose.
12.3 To the fullest extent permitted by South African law, King Hood Media shall not be liable for any direct, indirect, or consequential losses arising from the use of our services, products, or content.
13. GOVERNING LAW & JURISDICTION
13.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
13.2 The Parties consent to the exclusive jurisdiction of the High Court of South Africa (Gauteng Local Division, Johannesburg).
14. GENERAL
14.1 These Terms constitute the entire agreement between King Hood Media and the Client.
14.2 No variation shall be valid unless in writing and signed by both Parties.
14.3 King Hood Media reserves the right to update these Terms at any time, with updated versions published on our website.
